A new Government Emergency Ordinance regulating the pension system has entered into force

Once the global economical slump stretched its claws over Romania, the legislator hasn’t ceased trying different shifts meant to reduce the budgetary expenses, among which the pension cut off might be the most notorious.
 
Law no. 119/2010 struck very hard many categories of pensioners or future pensioners, including magistrates and Parliament members, just as militaries, policemen and others. These categories had their pension reduced to an outstanding extent, up to 70-80%, thus being a very controversial measure. The modality of calculating the new pensions’ amount was established by the Government Decisions No. 735 and 737/2010.
 
The above mentioned decisions have been censured by the courts that appreciated they were contradictory to the pensioners’ rights, and have been subject of many conflicts among groups of interests and clash of political views.
 
The Government Emergency Ordinance No. 59/2011 entered into force on June 30th confirms the inconsistent character of the above mentioned measures and the lack of transparency and predictability Romania was repeatedly accused of in front of European Court of Human Rights. The previously called ordinance abrogates the Government Decision No. 737/2010 and establishes a new methodology for calculation the pensions. 
 
We must also mention that the abrogated normative was also the subject of an appeal in front of Supreme Court of Cassation and Justice, that was supposed to be solved on November 1st , 2011.
